01Agreement and scope
These Terms are a contract between you and Sukoon Mind Horizon ("SKMH", "we", "us", or "our"). They apply to sukoonmindhorizon.in, related subdomains, mobile or digital experiences, content, accounts, sessions, programmes, subscriptions, professional services, corporate services, and any other SKMH offering that links to these Terms.
Additional terms may apply to a particular purchase, booking, promotion, partner service, or organisation programme. If there is a conflict, the specific terms for that service will apply only to the extent of that conflict.
02Our services and scope
SKMH provides digital wellbeing education, guided practices, community experiences, introductions to independent professionals, one-to-one sessions, group experiences, subscriptions, and workplace wellbeing services. Features, availability, pricing, content, and service providers may change as our platform develops.
Our content and services are educational and supportive. They are not a diagnosis, medical treatment, psychiatric service, emergency response, or replacement for licensed clinical care.
Do not use SKMH for an emergency. Contact local emergency services, a qualified crisis service, or an appropriate healthcare professional immediately.
03Eligibility and accounts
You must provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account. Notify us promptly if you suspect unauthorised access.
- You must be legally able to enter a contract in your jurisdiction.
- Children may use SKMH only where permitted by applicable law and with any required parent or guardian consent.
- One person or organisation may not create accounts for deceptive, abusive, or unauthorised purposes.
- We may verify information, restrict access, or suspend an account where necessary to protect users, professionals, the platform, or our legal rights.
04Bookings, fees, and payments
Prices, taxes, currency, inclusions, session length, cancellation windows, and renewal terms will be shown before you confirm a purchase or booking. You authorise SKMH or its payment provider to charge the selected payment method for confirmed amounts.
- Bookings are not final until the platform or our team confirms them.
- Payment providers may apply their own terms, verification requirements, and processing rules.
- Taxes, currency conversion charges, bank fees, and similar costs may be your responsibility.
- Refunds, credits, rescheduling, and cancellations are governed by the terms shown at checkout or booking. Where no specific policy is shown, we will assess the request reasonably and in line with applicable law.
- For subscriptions, renewal frequency and cancellation options will be disclosed before purchase. Cancelling stops future renewals but does not automatically reverse charges already due.
05Independent professionals and partners
Some SKMH experiences may involve independent guides, coaches, practitioners, experts, technology providers, payment partners, or other third parties. Unless we expressly state otherwise, those providers are independent contractors and not employees or agents of SKMH.
We may perform reasonable onboarding or quality checks, but we do not guarantee a provider's qualifications, availability, advice, outcomes, or suitability for your needs. You are responsible for deciding whether to proceed and should raise concerns with us promptly.
06Acceptable use and community standards
You agree to use SKMH lawfully, honestly, and respectfully. You must not:
- Harass, threaten, exploit, impersonate, discriminate against, or endanger another person.
- Upload or share unlawful, infringing, malicious, deceptive, or harmful material.
- Scrape, copy, reverse engineer, probe, disrupt, overload, or attempt to bypass platform security.
- Use SKMH to provide unauthorised professional advice, market products, collect data, or contact users for commercial purposes.
- Interfere with a session, community space, payment flow, review system, or another user's access.
We may remove content, moderate spaces, cancel bookings, or restrict accounts when we reasonably believe these standards or the law may have been breached.
07Content and intellectual property
SKMH and its licensors own or control the platform, brand, designs, software, text, audio, video, graphics, programmes, and other materials, except for content supplied by users or third parties. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access those materials for their intended purpose.
You must not reproduce, sell, publicly perform, distribute, modify, train a model on, or commercially exploit SKMH materials without written permission. You retain ownership of content you submit, but grant us a worldwide, royalty-free licence to host, display, moderate, adapt, and use it to operate, secure, and improve the services.
08Privacy and communications
Our Privacy Policy explains how we collect, use, protect, and disclose personal information. You agree that we may send service messages about account security, bookings, payments, changes, and support. Marketing communications can be managed through the available unsubscribe or preference controls.
09Disclaimers and limitation of liability
To the maximum extent permitted by law, SKMH services are provided on an "as available" and "as is" basis. We do not promise uninterrupted availability, error-free content, specific wellbeing outcomes, compatibility with every device, or that a service will meet every personal, clinical, commercial, or organisational requirement.
To the maximum extent permitted by law, SKMH and its officers, employees, contractors, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, goodwill, data, or opportunity arising from your use of the services. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10Your responsibility
You agree to defend, indemnify, and hold harmless SKMH and its related people and entities from claims, losses, liabilities, costs, and reasonable legal fees arising from your breach of these Terms, misuse of the services, unlawful content, violation of another person's rights, or negligent or wilful conduct.
11Suspension and termination
You may stop using SKMH at any time. We may suspend or terminate access, cancel a booking, or discontinue a service where required for safety, security, non-payment, misuse, legal compliance, operational reasons, or breach of these Terms. We will use reasonable efforts to provide notice where it is practical and appropriate.
Terms that by their nature should continue after termination, including intellectual property, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions, will survive.
12Changes to these Terms
We may update these Terms to reflect new services, legal requirements, security measures, or business changes. We will publish the updated version with a new date and may provide additional notice for material changes. Your continued use after the effective date means you accept the updated Terms.
13Governing law and disputes
Before starting a formal claim, you agree to contact us and give us a reasonable opportunity to investigate and resolve the issue. These Terms and any dispute relating to them will be governed by the laws and courts identified in the applicable SKMH order, organisation agreement, or, where none exists, the jurisdiction of the SKMH operating entity, subject to mandatory consumer protections in your location.
